Forever Fascinating Legal Stuff
There are many unique factors in the prosecution
of sex crimes, factors which were designed -- either by legislation or
by judicial interpretation -- to ensure conviction. And it is because
of these factors that the defense against such crimes is more than often
very costly. Considerable time is expended and legal expense
is incurred merely by your asking for and a lawyer giving answers to your
myriad of questions. This Website is designed with the hope
of shortening that time and diminishing your legal costs.
SIMPLE QUESTIONSare those which are generic, which apply to everyone, not specifically to your case. There are no simple questions for a specific case. To answer questions regarding a specific case, a lawyer must, for the most part, be acquainted with all the known facts.
So in the interest of fairness: I have created a payment scale according to the complexity of the question. That scale runs from $10 to $100 for SIMPLE QUESTIONS. But I'm relying on YOU to decide just how complex the question is which you want answered.

to the defense of all future readers who find themselves
charged falsely with a sex crime.
To make consulting services more feasible for those with false-allegations or custody problems, I have developed a multilevel fee structure, which allows me to offer at least some services at a less than usual hourly rate. However, a retainer or advance payment in advance of services is required, depending on the size of the record and type of case.
After the initial retainer, I also require a minimum
of $1000 to be maintained in the client escrow account at all times. The
fees will be deducted from the retainer as described below.
CAVEAT: I am an
attorney licensed to practice in Massachusetts, the U.S. District and Appeals
courts for the First Circuit. With pro
hac vice permission, I may represent clients
in other states and in other federal courts. Most states allow pro
hac vice representation; some also require
local counsel. I would want local counsel. Frequent travel
would be expensive for you and last-minute appearances would be, if not
nigh to impossible, certainly harrowing for me.
~ The Fluid Fee Structure ~
$2 per page for review of all the documents in the case provided the documents have been put into chronological order and sorted into correspondence and pleadings by the parties.
$3 page for review of all documents in the case if the documents are not in chronological order and are not sorted.
The documents include but are not limited to the
following documents:
(b) a list of all "players" in your case or cases
(c) written statement by reporter of abuse or rape
(d) administrative agency (for example, DSS, CPS, DYS) intake report
(e) administrative agency investigative report
(f) the process notes of social workers, psychologists, and psychiatrists
(g) medical reports, including doctors'
and nurses' notes, hospital records,
laboratory reports
(h) guardian ad litem reports
(i) deposition and trial transcripts
(j) docket sheets from each court
where an action to which you are a party is
pending
(k) court pleadings (motions, memoranda)
filed by you, your attorney, or
against
you
(l) court orders
(m) any other documents related to
the case (such as school teacher reports,
school
nurse reports)
Written strategy will be charged out at $350 per hour.
In recent the years, I have done an overabundance of pro bono work, and now I must rebuild up the coffers. But people still need help and the system still needs changing. My efforts have switched to taking cases that will have an impact on the system.
So my prices are changing . . . upwards, of course, for certain types of activities. I am charging more from rich Peters to help a few poorer Pauls. Robinhood in the Law.
So here are my new rates. These are only for those who come to me from this website.
$100-$175 an hour for editing of pleadings (motions and memoranda) already written. If they are well written and only minor things have to be corrected, then $75 an hour. (Some motions are on this website.) $100 an hour if more than "just minor" and up to $125 an hour if I must rewrite the entire pleading and incorporate the facts of your case.
$250 an hour for drafting, that is, for creating by thinking and writing, pleadings -- other than memoranda of law -- in a consulting capacity; those pleadings, which you may change in any way you want, will be filed not in my name.
$350 an hour for strategy: Following the review of the papers described above, written recommendations for strategy shall be prepared.
$350 an hour for telephone calls with your present or previous attorneys.
$350 for legal research and writing memoranda of law. If your state has all its case opinions online and searchable, I shall use that database. If I must use a commercial case reporting service to access your state's case law, I would have to pass the charges onto you. No choice!
Any court appearances would be at $350 an hour plus travel and lodging expenses. The charge for travel time would be minimal at $35-50 an hour, depending on length of trip and on whether I have to drive or take a plane. On a plane I can do "something else."
In Massachusetts, the legal community is beginning to frown on "ghost attorneys," attorneys who write pleadings which are to be signed by the client pro se. No definite action has been taken on this matter as yet. It is only a matter of time. I do not know the position of your state on the issue of "ghost attorneys."

Legal representation is also priced at an hourly rate. The prices comport with other legal fees, but an effort will be made to trim the fee, IF at all possible, to fit certain circumstances. Legal fees are payable in advance. If mutually acceptable arrangements are to be entered into to pay the legal fees, those arrangements must also be made in advance of representation.
